remembering the victimsFrom Sarah White’s appeal:   Neighbors alerted the fire department on December 31, 1975, that a home located at 24 Sayre Drive, Greenwood, Indiana, was in flames. The defendant was seen coming from the rear of the home; she was hysterical, screaming, and was restrained from reentering the burning home. The residence was the dwelling house of Charles and Carol Roberson and their four minor children, Michael, Dale, Gary and Rita. All six of the Robersons perished in the fire. The coroner testified that each of them died from carbon monoxide and smoke inhalation. The defendant had been living with the Roberson family.

After an extensive investigation into the cause of the fire, it was determined that the fire had been deliberately set. Burn patterns found in the home showed that an accelerant such as gasoline had been used. The accelerant caused the rapid burning of the home as well as the intense heat generated. Experts testified that the occupants of the home had probably perished within a few minutes of the initial conflagration.

The defendant was burned only slightly. Her testimony was to the effect that she had awakened from her bed on the living room couch, seen the flames on the wall near the Christmas tree, alerted the family, and attempted to get the children out. The smoke was so thick, though, that she lost touch with the children; she exited through a small, rear bedroom window, thinking that the children and the family would be behind her.

Testimony elicited at trial revealed that the defendant had made a telephone call, on the night of the fire, to her sister-in-law. The defendant was inquiring about a fire, which had occurred two days earlier, at her grandmother’s home. The defendant was most interested in how the fire started and in whether her siblings (who were living with her grandmother) had received new clothes as a result of the fire. It was less than four hours after the defendant had inquired about the fire at her grandmother’s house that the Roberson home was in flames. The arson investigators stated unequivocally that the Roberson fire was not accidental. The Christmas tree was a flame-proof variety; tests within the courtroom demonstrated that the tree would melt before it would ignite. The wiring, the appliances, the gas lines, and the furnace of the Roberson home were all checked. The results demonstrated that the fire itself had damaged each system, rather than the system causing the fire.

Additional evidence was introduced. Nude and pornographic photographs of the nineteen-year-old defendant were found in Charles Roberson’s billfold. Love letters written by the defendant to Charles Roberson were also found. The pajamas worn by the defendant were shown to be made of a highly flammable material; yet they were not burned at all. Inconsistencies in the defendant’s recollection of the fire were demonstrated through the testimony of those to whom the defendant had told her story. The defendant had a history of emotional disturbance, especially since the death of her father, and had spent the year prior to moving in with the Robersons as a patient in LaRue Carter Hospital.

remembering the victimsFrom Anastazia Schmid appeal: Schmid has an extensive history of psychological problems that began when she was a young girl. By 2001, when she was twenty-eight years of age, she had been married and divorced and was living with her boyfriend, Tony Heathcote (Heathcote), the victim. Schmid’s prior marriage had produced a daughter, and, on March 2, 2001, Schmid was informed that Heathcote allegedly had molested her daughter. Upon receiving this news, Schmid became very upset. Two days later, on March 4, 2001, Schmid and Heathcote were having sexual relations at their home using restraints, a dog collar, a leash, and a blindfold when Heathcote suggested that Schmid play the part of the little girl and Heathcote would play the part of the daddy. This statement caused Schmid to think of her daughter. At that time, Schmid obtained a knife and began stabbing Heathcote who was blindfolded and restrained at the ankles. Heathcote was stabbed thirty-nine (39) times and died. Later, Schmid indicated that at the time of the stabbing she had heard a voice telling her that she was the messiah and that Heathcote was evil and needed to be eliminated. Following a jury trial, Schmid was convicted with verdicts of guilty but mentally ill. This appeal ensued.

stand up for childrenFrom Anita Vega’s appeal: At some point in 1969 or 1970, Vega instructed her nine year old daughter, Margarita, to stay home from school and check on three year old Anna Marie. Anna Marie had wet her bed on the previous evening, and as a punishment had been beaten, deprived of food, and placed in a cold room without clothing. Margarita checked on Anna Marie and found that she had wet a pair of shorts that she had managed to find. Margarita informed Vega of Anna Marie’s condition; Vega responded by ordering Margarita to fill a tub with cold water. Vega then began kicking Anna Marie and beating her with her fists. When Anna Marie fell down, Vega picked her up by her hair and shook her. Vega continued beating Anna Marie for approximately five to ten minutes. By this time, Anna Marie’s nose and mouth were bloodied.

Vega led Anna Marie into the bathroom and checked the water that Margarita had placed into the tub. Upon discovering that the water was warm, she smacked Margarita, and ordered her to place cold water in the tub. After Margarita did so, Vega beat Anna Marie again. During this beating, Anna Marie fell backwards into the tub. Vega pulled her out of the tub and beat her again. Before leaving the room, Vega ordered Margarita to place Anna Marie in the tub. Margarita persuaded Anna Marie to stand in the tub, but was unable to persuade her to sit down.

Vega reentered the bathroom and observed Anna Marie standing in the tub. Vega then struck Anna Marie’s head with sufficient force to knock her out of the tub. Vega then picked up Anna Marie, and threw her head first into the tub. When Anna Marie gasped for air, Vega struck her again and held her head under the water. Vega then forced her weakening daughter to sit in the water. Vega then told Margarita to shower Anna Marie with cold water and “leave her there.” Anna Marie was left alone in the bathroom with cold water running on her.

After watching soap operas for a number of hours, Vega asked Margarita to check on Anna Marie. Margarita entered the bathroom and observed Anna Marie floating face down in the water. Margarita placed Anna Marie on her stomach on the floor, pushed on her back, and observed water come out of her nose and throat. Margarita noted that Anna Marie was “ice cold.”.

Margarita informed Vega that she believed Anna Marie was dead. Vega responded, “She’s not dead, stupid … Bring her out here.”. Margarita wrapped a towelaround Anna Marie and carried her out of the bathroom.

Anna Marie began making noises, and Vega instructed Margarita to place her on the unheated back porch. Margarita wrapped Anna Marie in a blanket and placed her on the porch. Margarita left the door open to enable heat from the house to reach the porch. When Vega discovered that the door was open, she smacked Margarita and ordered her to close it. Vega then “put her … knuckle real hard under [Margarita’s] chin” and said, “If you ever tell I’ll kill you and you’ve seen me do it so you know I can.”

Later that afternoon, Margarita’s siblings returned from school. Vega informed one of the boys that Anna Marie was dead and that her funeral occurred while he was at school. When Vega forced Margarita to go out on the porch to get toys for one of the children, Margarita heard Anna Marie “making noises” that were “weird” and “more deep.”.

Later that evening, Vega’s future husband, Luis, returned home from work. Margarita overheard Vega and Luis having a discussion in their bedroom. At one point, Margarita heard Luis say, “Well, didn’t you know that could kill her?”.

Margarita heard Luis exit the house. Luis then entered the house carrying a box. Margarita observed that the blanket that she used to cover Anna Marie was sticking out of the box. Margarita heard Vega tell Luis to “hurry up” because “if … a policeman saw him walking down the street carrying a box we’d all be in trouble.” (R. 121-122).

When Luis returned home, Margarita heard Vega ask him what took so long. Luis responded that “it wasn’t easy to bury a body in frozen ground.”.

Serial Killer: Howard Arthur Allen

remembering the victimsFrom Howard Allen’s appeal for the Ernestine Griffin murder: Allen murdered 74-year-old Ernestine Griffin in her Indianapolis home. Police determined that Griffin had been killed by a combination of a knife wound to her chest and a blow to her head. On a kitchen counter, police found a piece of paper with Allen’s name and phone number on it. A neighbor of Griffin’s informed police that Allen had inquired with Griffin about a car that the neighbor had for sale. Police later discovered Griffin’s camera at the car wash where Allen worked. After extensive questioning, Allen admitted to the police that he had struck Griffin, but denied killing her.

Allen was charged with Murder, See footnote Felony Murder, See footnote and Robbery. See footnote A jury convicted Allen on all three charges and recommended a sentence of death. The trial court sentenced Allen to death on August 30, 1988.
